4. What legal bases do we rely on to process personal data?
Nouèm Oil & Nature only processes personal data where there is a valid legal basis.
When placing an order, processing is primarily necessary for the performance of the contract. For instance, without a name and delivery address, we cannot deliver your order.
We process certain personal data pursuant to a statutory obligation, such as data that forms part of our financial records.
For security, fraud prevention, handling certain commercial disputes and safeguarding our webshop, we may rely on legitimate interests, provided all statutory requirements are met.
Where consent is required, such as for specific marketing activities or tracking technologies, we process personal data based on your consent. Consent can be withdrawn at any time.
5. Orders
When you place an order via www.nouemoil.com, we use the details required to fulfil your order.
This includes, among other things, your contact details, delivery address, billing details, the products ordered, the purchase amount and information regarding your payment status.
Where necessary, this data may be shared with third parties involved in fulfilling your order, such as our webshop platform provider, payment service provider and carrier.

For payment processing, Nouèm Oil & Nature uses Stripe and the payment methods offered through Stripe.
Sensitive payment details, such as full credit card details, are not stored by Nouèm Oil & Nature, but are processed directly by the relevant payment service provider.
The relevant payment service provider may act as an independent data controller for certain processing activities. In that case, that service provider's own privacy policy also applies.
When using pay-later services such as Klarna, credit checks or acceptance assessments may be carried out. Nouèm Oil & Nature has no influence over these assessments and only receives the information strictly necessary for the completion of the order.
7. Hosting and webshop platform
The domain name and hosting of the Nouèm Oil & Nature webshop are provided by Antagonist. Webshop data is stored and processed via Supabase (database). Personal data such as contact details, delivery and billing details, order and transaction data, and technical data such as IP addresses are processed in this context. Antagonist and Supabase process this data exclusively on behalf of Nouèm Oil & Nature. Emails regarding your order are sent via Resend.
8. Shipping and delivery
To deliver an order, we share the necessary personal data with the carrier delivering the order.
This may include, for example, your name, delivery address, email address and/or telephone number where required for delivery, track & trace, or delivery updates.
We do not share more data with a carrier such as PostNL or DHL than is reasonably necessary for the execution of the delivery.
9. Customer service and complaints
When you contact Nouèm Oil & Nature, we process the information you provide in order to handle your query, complaint, return request or other enquiry.
This may include your contact details, order number, correspondence and any photos submitted by you.
Please refrain from providing personal data that is not necessary for handling your request.
10. Notifications regarding cosmetic products
When you contact us regarding an undesirable effect from a cosmetic product, the information you provide may include data concerning your health.
Nouèm Oil & Nature processes such information exclusively to the extent necessary and legally permitted to handle and investigate your report, monitor product safety, and comply with applicable statutory obligations.
Where health data is processed, this is done solely if, in addition to a GDPR legal basis, an applicable exception for special category personal data applies.
In the event of a serious undesirable effect (SUE), the responsible person and/or distributor may be legally required to report certain information to the competent authority. Article 23 of the European Cosmetics Regulation sets out a specific reporting obligation in this regard. When making such reports, Nouèm Oil & Nature only processes data strictly necessary for that purpose.
11. Newsletter and marketing
To send newsletters and marketing communications, Nouèm Oil & Nature may use Klaviyo or comparable email marketing software.
When you subscribe to a newsletter or other marketing communications requiring consent, we use your data only after you have given your consent.
You can unsubscribe at any time via the unsubscribe link in the email or by contacting us at info@nouemoil.com.
Where permitted by law to inform existing customers about similar products without separate consent, we always provide a straightforward option to object to further commercial communications.
Withdrawing consent does not affect the lawfulness of processing carried out prior to the withdrawal.

Among other things, we use security features available within our webshop and payment services.
However, no electronic data processing system can guarantee an absolute zero risk.
In the event of a personal data breach, we act in accordance with applicable statutory obligations.
18. Your privacy rights

In principle, we respond to a privacy request within one month. This period may only be extended under the terms of the GDPR in the case of complex or numerous requests.
19. No solely automated decision-making by Nouèm Oil & Nature
Nouèm Oil & Nature does not take decisions based solely on automated processing that produce legal effects or similarly significant effects for the customer.
Third parties, such as a pay-later service provider, may use automated checks for their own services. Where they independently process personal data in doing so, their own privacy terms and statutory obligations apply.
20. Right to lodge a complaint
Do you have questions or complaints regarding how Nouèm Oil & Nature handles personal data? Please feel free to contact us first at info@nouemoil.com.
In addition, you have the right to lodge a complaint with the Dutch Data Protection Authority (*Autoriteit Persoonsgegevens*).
